Pursuant to Legal Notice No. 78 of 28th April, 2020, the following additional products are now exempted from Pre-Arrival Clearance as required under the Pre Export Verification of Conformity to standards Program (PVoC Program):
- Plants, seeds and planting materials;
- Human and veterinary pharmaceutical products;
- Pesticides;
- Printed matter and recorded digital media;
- Aircraft and aircraft parts;
- Marinecraft and marinecraft parts;
- Live animals, carcasses and hatching eggs;
- Explosives, arms and ammunition;
- Tissues and organs; and
- Radioactive materials and isotopes.
This means that the products are now also exempted from the mandatory inspection fees that were required in order for the products to be subjected to Pre-Arrival Clearance under the PVoC Program.
Under the PVoC Program, imported goods are inspected at the country of origin of such goods by PVoC Agents who issue a certificate indicating that the goods conform to Kenyan Standards. Once the goods arrive at the ports of entry in Kenya, it is no longer required that they be subjected to inspection by the relevant agencies. PVoC Agents are companies contracted by KEBS to undertake conformity assessment activities in the country of origin for products being imported into Kenya.
According to the Legal Notice, importers of printed matter and recorded digital media will be required to provide a declaration that such materials have not violated any intellectual property rights. On the other hand, importers of the other exempted products will be required to provide proof of compliance with relevant Regulations.
This Legal Notice amends Legal Notice No. 183 the Standards (Verification of Conformity to Standards and other Applicable Regulations of Imports) Regulations, 2019 that previously regulated the importation of goods into Kenya.
