New land rules and regulations save for the Community Land Act regulations have now received the prerequisite approval from the National Assembly as indicated by Lands Cabinet Secretary in a press statement issued on 27th April, 2018.
The Ministry of Lands (“MoL”) has now fully complied with the orders issued by the late Justice Onguto requiring the MoL to rectify the anomaly made in coming up with the Land Rules without consulting the relevant institutions.
The effect of this approval is that the titles that were issued after 2013 are now valid and uniform land registration land forms shall now be in use as anticipated in the Land Act and Land Registration Act 2012.
Further implication of the Parliamentary approval is the coming into force of rules relating to assessment of just compensation in case of adverse possession, rules on extension and renewal of leases, regulations on allocation of public land and rules relating to conversion of land from one category to another i.e. public to private.
