Extension of the Petroleum (Liquefied Petroleum Gas) Regulations, 2019

The deadline for complying with the Petroleum (Liquefied Petroleum Gas) Regulations, 2019 (“the Regulations”) has been extended to 31st March, 2020.

The Regulations were made pursuant to the coming into force of the Petroleum Act, 2019 (“the Act”). A summary of the Act can be found in our legal update dated 20th March, 2019.

The Regulations require all persons undertaking a liquefied petroleum gas (“LPG”) business to make an application for a licence to the Energy and Petroleum Regulatory Authority (“the Authority”) or its licensing agents, in the prescribed manner.

Additionally, the Regulations require all persons undertaking a LPG business to obtain prior written consent from the brand owner of the LPG, before filling the gas into cylinders. A copy of the consent must be submitted to the Authority by the brand owner.

The Regulations further require that an application for the renewal of a licence be made at least thirty days prior to the expiry of the existing licence.

It is important to note that where an application for the renewal of a licence is made less than thirty days before the expiry of the existing licence, an additional fee equal to twenty percent of the licence fee shall be payable in addition to the licence fee.
