INTRODUCTION OF A COMMERCIAL REGISTRY AT THE MILIMANI COMMERCIAL MAGISTRATES COURT

On 2nd March 2021, the Chief Magistrate Commercial Court at Milimani issued a public notice for the conduct of commercial suits filed at the court.  In this regard, the court has directed that the commercial registry be made independent from the civil registry in order to allow for efficiency in the handling of commercial cases. The commercial registry will now be solely responsible for the issuance of summons, decrees and fixing of dates in commercial suits.

The court has designated the Honorable E.M Kagoni (Principal Magistrate) and the Honorable A.N Oganda (Senior Resident Magistrate) to hear and determine fresh commercial matters filed at the registry and the pending commercial suits that have not proceeded for hearing. Ongoing commercial suits which have already proceeded for hearing will continue before the court presently in conduct of the matter.

The introduction of a separate registry and designation of magistrates dedicated to dispensing with the commercial suits will fast track the conclusion of commercial matters. However, there may be need to designate a Senior Principal Magistrate and a Chief Magistrate to attend to commercial suits whose subject matter exceed Ksh 10,000,000, noting that the pecuniary jurisdiction for the nominated magistrates ranking as Principal Magistrate and Senior Resident Magistrate does not exceed Ksh, 10,000,000.00/-
