The Anti-Counterfeit Authority (ACA) has today (11th April 2023) issued a Public Notice announcing the expansion of the recordation enforcement program through the ACA Import Permit process to include additional HS Codes. This is in compliance with the Constitution’s Article 40(5), the Anti-Counterfeit Act No. 13 of 2008 (Section 34B), and the Anti-Counterfeit (Recordation) Regulations LN 118/2021 (R4). The ACA Import Permit process which was focused on the following categories of goods: Alcoholic beverages, Electronics and Electricals, Pharmaceuticals, Apparel Footwear and Cosmetics (with effect from 1st January 2023) has now been expanded to regulate the following additional HS Codes, effective 01st May, 2023:

The ACA regulated HS Codes based on the East African Community Customs Union, Common External Tariff, Harmonized Commodity Description and Coding System, version 2022, are available here.
Starting 01st May, 2023, all consignments falling under the selected categories of HS Codes must be accompanied by the ACA permit (Form ACA 2B) for Import Declaration Form (IDF) applications in accordance with the provisions of Section 34B of the Anti-Counterfeit Act and the Anti-Counterfeit Recordation Regulations 2021. The Form ACA 2B is submitted and processed via the KenTrade Single Window system before the IDF is approved.
