Introduction.

Navigating Kenya’s immigration rules can feel like driving through a roundabout with no exits, but the introduction of the Class R work permit for East African Community nationals (EAC) just paved a scenic shortcut. Pursuant to the Kenya Citizenship and Immigration (Amendment) Regulations, 2024 Legal Notice 198 of 2024 (the “Regulations”) this new permit category marks a welcome overhaul of the regulatory landscape.

What is the Class R Permit?

The permit is exclusively for citizens of the EAC member states, and its applicable to persons who;

  • are not prohibited immigrants (please find here the list of persons classified as illegal immigrants);
  • intend to reside, engage in employment, activity, business, trade or engage in any prescribed profession; and
  • their presence will be of benefit to Kenya.

What is the application process?

All applications for the permit must be submitted formally  via the Kenyan Department of Immigration Services website, together with supporting documents. Now, here is the cherry on top, pursuant to the Regulations applicants are not required to pay any processing fee or annual renewal fees for this permit.
